2. Visiting this website
When you open these pages, the web server processes technically necessary data: IP address, date and time, requested address, browser and operating system. This serves to deliver the pages and to keep them secure (Art. 6(1)(f) GDPR). The logs are deleted after a short time.
We only use technically necessary cookies (session, protection against forged forms, chosen language). There are no advertising or analytics cookies and no social media plugins on this website. Fonts are loaded from our own server.
3. Registration and user account
When you register, we process the name of your company, your name, your email address, optionally your phone number and your password (stored encrypted only). We need this data to provide ImotDesk to you (Art. 6(1)(b) GDPR).
To prevent abuse, we limit the number of registration attempts.
4. Data you enter in ImotDesk
We process properties, owners, contacts and other content you enter in ImotDesk on your behalf. Your company is the controller for personal data of your clients and owners; we process it only according to your instructions (Art. 28 GDPR).
Your data is only visible to your company. Other companies only see properties you explicitly share – without owner data and internal details.
5. Maps and address search
ImotDesk shows maps from OpenStreetMap and searches addresses via the Nominatim service (OpenStreetMap Foundation, United Kingdom). Your IP address is transmitted to these servers. The legal basis is Art. 6(1)(b) and (f) GDPR. The EU Commission has adopted an adequacy decision for the United Kingdom.
6. Property portal obyavi.eu
On the portal obyavi.eu we show property offers of several agencies. Pages without a form (home page, search, categories, agencies, guides) set no cookies. Pages with a form only set technically necessary cookies (session, protection against forged forms).
We store search queries without IP address and without reference to a person (wording, number, date) to recognise frequent wishes and create suitable search pages; queries containing an e-mail address, phone number or link are not stored. To limit abuse, a shortened, encrypted network range is counted that cannot be traced back to a person. To understand the search, the search text is sent to the chosen AI provider (OpenAI or Anthropic, see AI features). The legal basis is Art. 6(1)(f) GDPR.
If you contact an agency through the form of a listing, we pass your name, e-mail address, optionally your phone number and your message to the agency that published the listing. It receives the request in its customer management system and is responsible for your data from then on (Art. 6(1)(a) and (b) GDPR).
7. Search and selling requests on the portal
With the forms “Search request” and “Offer your property” we collect your name, e-mail address, optionally your phone number, your details about the wish or the property (offer type, property type, places, budget or price, rooms, area, timeframe, message), the page you came from, and the wording and time of your consent.
The operator of the portal reviews the requests and passes them on to one or more suitable real estate agencies, which will contact you. They may be passed on against a referral fee that the agency pays to the operator; it is free of charge for you. From receipt, the respective agency is itself responsible for your data. The legal basis is your consent (Art. 6(1)(a) GDPR).
You can withdraw your consent at any time with effect for the future, for example by e-mail to [email protected]; after that we no longer pass on your details. We delete requests no later than 24 months after receipt. The e-mail notification to the operator contains neither your contact details nor your message.
8. AI features (Anthropic, OpenAI)
When the AI assistant is switched on, texts and details of properties and complexes (e.g. descriptions, areas, amenities) are sent for translation and wording to the provider chosen by the operator: Anthropic (Claude; Anthropic, PBC, USA or Anthropic Ireland, Limited) or OpenAI (OpenAI, L.L.C., USA or OpenAI Ireland Ltd.). For sorting search results by meaning, property texts and search requests are sent to OpenAI. Search requests from the property list are sent as well. If a user pastes a client message to have contact details and search profile filled in, this text including the contact details it contains is sent – only after an explicit click. Beyond that, personal data of clients and owners is not sent to these providers. The legal basis is Art. 6(1)(b) and (f) GDPR; the transfer to the USA is based on standard contractual clauses or the EU-US Data Privacy Framework.
9. Notifications and emails
We send you messages necessary for using the service, for example about new inquiries or partner requests. We only send newsletters with your explicit consent.
10. Retention
We store your data for as long as your account exists. After cancellation we delete it unless statutory retention obligations apply (for example for invoices).
11. Your rights
You have the right of access, rectification, erasure, restriction of processing, data portability and objection. You can withdraw consent at any time with effect for the future. Write to us at [email protected].
